Dawn Light Gaming is the seller of record for all orders placed through the Site.

2. Trademarks and disclaimer of affiliation

Dawn Light Gaming is an independent retailer. We are not affiliated with, endorsed by, sponsored by, licensed by, or otherwise connected to any trading card game publisher, manufacturer, distributor, or grading company.

We sell genuine, lawfully acquired products. Where we refer to a publisher, game, set, or grading company by name, we do so solely to identify the actual goods we are offering for sale — the accurate description of genuine products for resale. Such use does not imply any relationship between us and the rights holder.

The following names and marks are the property of their respective owners:

  • Pokémon and the Pokémon Trading Card Game — Nintendo, Creatures Inc., GAME FREAK inc., and The Pokémon Company International.
  • Magic: The Gathering — Wizards of the Coast LLC.
  • Yu-Gi-Oh! — Konami Digital Entertainment.
  • One Piece Card Game, Dragon Ball Super Card Game, Digimon Card Game — Bandai.
  • PSA, BGS/Beckett, CGC, SGC, TAG and other grading marks — their respective grading companies.

All other trademarks, service marks, trade names, and trade dress appearing on the Site are the property of their respective owners. Trim this list to the lines you actually stock and confirm current ownership before publishing.

Rights holders: if you believe our use of your mark exceeds what is necessary to identify genuine goods, contact us at [dawnlightgaming@dawnlightsolutions.com] before pursuing other action. We respond to good-faith notices promptly.

3. Our own intellectual property

All original content on the Site — including our name, logo, product photography, written product descriptions, condition assessments, grading notes, site copy, layout, and graphics — is owned by [Dawn Light Gaming] or licensed to us, and is protected by copyright and trademark law.

You may not copy, reproduce, scrape, republish, distribute, or use our original photography or descriptions for commercial purposes without our prior written permission. Automated scraping, crawling, or bulk extraction of Site content, pricing, or inventory data is prohibited.

Limited personal, non-commercial use — viewing pages, printing an order confirmation, sharing a product link — is permitted.

4. Product listings, condition, and images

  • Graded cards and high-value singles are photographed individually. You will receive the exact item pictured, identified by its certification number where applicable.
  • Ungraded singles and sealed product may be shown using representative or stock images. You will receive an item matching the stated set, print, and condition grade, but not necessarily the specific copy pictured.
  • Condition descriptions for ungraded cards reflect our own assessment using [standard NM / LP / MP / HP / DMG terminology]. Condition assessment is inherently subjective and reasonable graders can differ.
  • Colors may vary between your screen and the physical item.

We take reasonable care to describe items accurately. If an item is materially different from its description, Section 3 of our Refund Policy applies.

5. Third-party grading — opinions, not guarantees

Grades assigned by PSA, BGS, CGC, SGC, TAG, or any other grading service are the subjective opinions of that company, not statements of fact and not warranties by us.

  • We do not grade cards ourselves and we do not control, influence, or guarantee any third party's grade.
  • We make no representation that a card would receive the same grade if resubmitted, crossed over to another company, or reviewed for a grade bump.
  • Population reports, census figures, and label designations are maintained by the grading companies and change over time.
  • We verify the certification number and slab integrity of graded items we sell to the best of our ability, but authentication and grading claims are ultimately those of the issuing company.

If you believe a slab you purchased from us is not genuine, contact us immediately and we will investigate and make it right.

6. No investment or financial advice

Trading cards are collectibles, not investments or securities. Nothing on the Site — including prices, market comparisons, population data, sales history, "hot" or "trending" labels, or any commentary — constitutes investment, financial, tax, or appraisal advice, or a recommendation to buy, hold, or sell.

Collectible values are volatile and can fall as well as rise. Past sales are not indicative of future value. We make no representation or guarantee regarding the current or future value, appreciation, resale price, or liquidity of any item we sell. Any purchase decision is yours alone, and you should consult your own advisors before treating collectibles as a financial asset.

7. Pricing, availability, and errors

Prices are listed in [USD] and are subject to change without notice. We make every effort to ensure accuracy, but the Site may contain typographical errors, pricing errors, or inaccuracies in availability or description.

We reserve the right to correct any error and to cancel and fully refund any order placed at an incorrect price or for an item that is out of stock, even after order confirmation and after the 15-minute cancellation window in our Refund Policy has closed. If we cancel an order on this basis, you will receive a full refund of everything paid, including shipping, and we will notify you by email. This is the only circumstance in which we cancel a confirmed order.

Inventory is limited and stock levels can change between the time you view a page and the time you check out. We may limit quantities per customer, per household, or per order, particularly on new releases and allocated product.

8. Eligibility and age

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. If you are under 18, you may use the Site only with the involvement and consent of a parent or legal guardian, who is responsible for the order and bound by our policies.

We do not knowingly collect personal information from children under 13. See our Privacy Policy.

9. Copyright complaints (DMCA)

We respect intellectual property rights. If you believe content on the Site infringes your copyright, send a written notice to our designated agent containing the elements required by 17 U.S.C. § 512(c)(3):

We will remove or disable access to material in response to valid notices and will terminate the accounts of repeat infringers. Counter-notices may be submitted to the same agent.

Posting this text is not sufficient on its own — the designated agent must also be registered with the U.S. Copyright Office for safe harbor to apply.

10. User-submitted content

If you post reviews, photographs, comments, or other material to the Site, you represent that you own or have the right to submit it, and you grant us a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and distribute it in connection with the Site and our marketing. You retain ownership.

We may remove any submission at our discretion, including content that is unlawful, infringing, deceptive, harassing, or off-topic. We do not pay for reviews or condition submissions of reviews on their being positive.

11. External links

The Site may link to third-party websites, including grading company lookup tools, publisher pages, price aggregators, and carrier tracking. We do not control those sites, do not endorse their content, and are not responsible for their accuracy, availability, security, or privacy practices. Following an external link is at your own risk.

12. Disclaimer of warranties

Except as expressly stated in these policies and to the fullest extent permitted by law, the Site and its content are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

Nothing in this section limits the express commitments we make about the authenticity, condition, and description of the products we sell, or any warranty that cannot be excluded under applicable law. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.

13. Limitation of liability

To the fullest extent permitted by law, [Dawn Light Gaming], its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of collectible value, arising out of or relating to your use of the Site or any product purchased through it — whether based in contract, tort, strict liability, or otherwise, and even if we were advised of the possibility of such damages.

Our total aggregate liability for any claim relating to a product will not exceed the amount you paid for that product.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you. Nothing here limits liability for fraud, willful misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be limited.

14. Governing law and disputes

This Legal Notice and all related policies are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. The UN Convention on Contracts for the International Sale of Goods does not apply.

You and we agree that any dispute will be brought exclusively in the state or federal courts located in [Orange, California], and you consent to personal jurisdiction there.

 

15. Your consumer rights

Nothing in this Legal Notice limits any rights you have under the mandatory consumer protection laws of your country, state, or region. Where local law gives you a right or remedy beyond what is described here, that law applies.

17. General

  • Severability. If any provision is held unenforceable, the remainder stays in effect.
  • No waiver. Our failure to enforce a provision is not a waiver of it.
  • Assignment. You may not assign your rights under these policies. We may assign ours in connection with a merger, acquisition, or sale of assets.
  • Entire agreement. These policies, together with your order confirmation, are the entire agreement between us regarding your purchase.
  • Changes. We may update this Legal Notice at any time. The version in effect when you place an order governs that order. Material changes take effect when posted with a revised "Last updated" date.

Appendix — include only if applicable

Randomized products, repacks, and mystery items. If you sell repacks, mystery boxes, or randomized bundles, add a section disclosing: the odds or a clear statement that contents are random; that no specific card is guaranteed; the minimum value included; that these products are non-returnable; and an 18+ purchase requirement. Randomized paid products draw scrutiny under state gambling and unfair-practice statutes, and disclosure is the primary defense.

Consignment. If you sell on behalf of third-party consignors, disclose that fact, who holds title at the time of sale, and who is responsible for authenticity.
